Acceptance of Terms

By accessing or using ZeroMissCall ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all subscribers, users, and others who access or use the Service. By creating an account, starting a free trial, or making a payment, you confirm that you have read, understood, and accepted these Terms.

Description of Service

ZeroMissCall provides an AI-powered missed call text-back service designed primarily for small plumbing businesses in the United States. When a call to your business goes unanswered, the Service automatically sends an SMS response to the caller, engages in a text conversation using artificial intelligence, and alerts you to any urgent messages.

The Service operates using the following third-party infrastructure:

  • Twilio — for SMS delivery and US phone number provisioning
  • OpenAI — for AI-powered conversation processing
  • Stripe — for subscription billing and payment processing
  • MongoDB and Railway — for data storage and application hosting

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

Eligibility

You must be at least 18 years of age and legally able to enter into contracts to use ZeroMissCall. The Service is intended for use by business owners and operators in the United States. By using the Service, you represent and warrant that you meet these requirements.

You are responsible for ensuring that your use of the Service complies with all applicable laws in your state and locality.

Subscription & Billing

ZeroMissCall is offered on a recurring subscription basis, billed monthly or annually depending on the plan you select. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

  • Subscriptions automatically renew at the end of each billing period unless cancelled beforehand
  • You may cancel at any time through your billing portal — cancellations take effect at the end of the current billing period
  • We do not offer prorated refunds for mid-period cancellations, except where required by law or as covered by our 30-day money-back guarantee
  • Prices are in US dollars and subject to change with 30 days' notice to active subscribers
  • Failed payments may result in service suspension until resolved

Free Trial

New subscribers receive a 14-day free trial with no credit card required at signup. At the end of the trial period, you will be asked to enter payment details to continue. If you do not add a payment method, your account will be deactivated and your data retained for 30 days.

We also offer a 30-day money-back guarantee for first-time paying subscribers. If ZeroMissCall does not recover at least one job worth more than your subscription cost in your first 30 days, contact us at hello@zeromisscall.com for a full refund. This guarantee applies once per business and is at our reasonable discretion.

Acceptable Use

You agree to use ZeroMissCall only for lawful business purposes. You must not use the Service to:

  • Send unsolicited marketing messages (spam) to people who have not contacted your business
  • Impersonate another business or individual
  • Violate any applicable local, state, or federal law or regulation
  • Attempt to reverse-engineer, scrape, or circumvent any part of the Service
  • Transmit harmful, abusive, defamatory, or fraudulent content
  • Use the Service in any way that could damage, overburden, or impair our infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

SMS Compliance (TCPA)

ZeroMissCall is designed to respond only to individuals who have initiated contact by calling your business number. These are inbound-initiated contacts, which generally fall within acceptable use under the Telephone Consumer Protection Act (TCPA).

However, you as the account holder remain solely responsible for ensuring your use of the Service complies with all applicable telecommunications laws, including the TCPA, CTIA guidelines, and any state-level regulations that apply to your business and location.

We strongly recommend you consult legal counsel if you are unsure about your obligations under applicable SMS and telecommunications law. ZeroMissCall accepts no liability for regulatory violations arising from your use of the Service.

AI-Generated Content

The Service uses artificial intelligence to generate text message responses on behalf of your business. While we take care to train the AI appropriately for plumbing business contexts, we cannot guarantee the accuracy, appropriateness, or completeness of every AI-generated response.

You acknowledge that:

  • AI responses are generated automatically and may occasionally be inaccurate or inappropriate
  • You are responsible for reviewing your conversation history and correcting any customer misunderstandings
  • ZeroMissCall is not liable for any loss or damage arising from AI-generated content sent to your customers

You can customise the AI's responses through your dashboard, and we encourage you to review and set appropriate custom FAQs for your business.

Intellectual Property

All content, software, branding, and technology that makes up the ZeroMissCall platform is owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written consent.

You retain ownership of all content you provide to the Service, including your business profile information and custom FAQ responses. By providing this content, you grant us a limited licence to use it solely for the purpose of delivering the Service to you.

Limitation of Liability

To the fullest extent permitted by applicable law, ZeroMissCall and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Lost revenue or missed business opportunities
  • Inaccurate or inappropriate AI-generated responses
  • Service outages, downtime, or data loss
  • Regulatory penalties arising from your use of SMS features

Our total liability to you for any claim arising from the Service shall not exceed the total amount you paid us in the three months preceding the claim.

Termination

You may cancel your subscription at any time through your billing portal. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or third parties.

Upon termination, your access to the Service will cease. Your data will be retained for 90 days before permanent deletion, during which time you may request an export of your conversation history by contacting hello@zeromisscall.com.

Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify active subscribers by email at least 14 days before any material changes take effect.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes come into effect.
